So the claim made in this thread can't apply to the victim in the first place, and they have no valid case. Of course, human judgment is involved so the judge or prosecutor can make mistakes, but we're talking about what would normally happen.
If they were giving some other reason why it's rape, like if she lied and said she was threatened with violence or held down while she protested, then it would go to trial.
